Welcome to Psy.nz ("Platform", "Website", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Psy.nz website, applications, and all related services. By accessing the Platform, creating an account, or using any of its features, you agree to comply with these Terms. If you do not accept these Terms, you should discontinue using the Platform immediately.

Psy.nz is an online platform that connects individuals with psychologists, counselors, mental health organizations, and related professional services. The Platform also provides digital tools that enable licensed professionals and organizations to publish profiles, present their services, communicate with clients, schedule appointments, and manage aspects of their professional practice.

Psy.nz is a technology platform and is not a hospital, medical center, healthcare provider, emergency service, or licensed mental health clinic. Unless expressly stated otherwise, we do not provide psychological treatment, psychotherapy, counseling, psychiatric services, diagnosis, or medical advice. Any healthcare or psychological services available through the Platform are provided independently by the individual psychologist or organization offering those services.

All information published on the Platform is intended for general informational purposes only and should not be interpreted as medical, psychological, psychiatric, legal, or professional advice. Decisions regarding diagnosis, treatment, medication, or healthcare should always be made in consultation with an appropriately qualified professional.

If you believe that you or another person is experiencing a mental health crisis, suicidal thoughts, or any situation requiring immediate assistance, do not rely on the Platform. Contact your local emergency services or the nearest emergency healthcare facility without delay.

To create an account, you must meet the minimum legal age required under the laws applicable in your jurisdiction. Where permitted by law, minors may use the Platform only with the consent or supervision of a parent or legal guardian.

When registering an account, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. If you suspect unauthorized access to your account, you must notify us promptly.

Psychologists, counselors, clinics, and other organizations using Psy.nz are solely responsible for ensuring that all information published on their profiles remains accurate, lawful, and up to date. Professionals are responsible for maintaining all licenses, certifications, registrations, permits, insurance, and qualifications required by applicable laws. While Psy.nz may request documentation to verify professional credentials, we cannot guarantee the accuracy, completeness, or authenticity of information submitted by users.

Users are responsible for independently evaluating whether a professional is suitable for their individual needs. The presence of a professional profile on Psy.nz does not constitute an endorsement, recommendation, certification, guarantee, or representation regarding the quality or competence of that professional.

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not impersonate another individual or organization, publish false or misleading information, upload malicious software, attempt unauthorized access to the Platform, collect personal information without permission, distribute spam, violate intellectual property rights, publish unlawful content, or use automated systems to scrape or extract data without our prior written authorization.

You retain ownership of any content you submit to the Platform, including profile information, photographs, articles, reviews, comments, documents, and other materials. By submitting content, you grant Psy.nz a worldwide, non-exclusive, royalty-free license to host, display, reproduce, distribute, adapt for technical purposes, and otherwise use such content as necessary to operate, improve, and promote the Platform.

By submitting content, you represent and warrant that you own the content or have obtained all necessary rights and permissions required to publish it, and that its publication does not infringe any third-party rights or violate applicable law.

Psy.nz reserves the right, but is not obligated, to review, edit, suspend, reject, or remove any content or account that violates these Terms, applicable law, or may negatively affect the operation or reputation of the Platform.

The Platform provides communication tools that allow users and professionals to interact directly. Psy.nz is not responsible for the content of these communications and is not a party to any professional relationship established between users and psychologists through the Platform.

Where appointment scheduling features are available, appointment confirmations, cancellations, consultation fees, refund policies, and the provision of professional services are determined solely by the individual psychologist or organization unless explicitly stated otherwise. Psy.nz is not responsible for missed appointments, service quality, treatment outcomes, cancellations, or disputes arising between clients and professionals.

If payment functionality is provided, you agree to supply accurate billing information and authorize all applicable charges associated with your transactions. Payment processing may be handled by independent third-party payment providers operating under their own terms of service and privacy policies.

You acknowledge that the results of psychological treatment and counseling vary from person to person. Psy.nz makes no guarantees regarding therapeutic outcomes, medical results, personal improvement, or the effectiveness of any professional listed on the Platform.

The Platform may include links to third-party websites, services, or applications for your convenience. Psy.nz does not control these external resources and accepts no responsibility for their content, availability, security, or privacy practices.

All software, databases, source code, graphics, logos, trademarks, website design, documentation, and other intellectual property associated with Psy.nz remain the property of Psy.nz or its licensors and are protected under applicable intellectual property laws. Unless expressly permitted in writing, you may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works based on any part of the Platform.

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Psy.nz disclaims all warranties, whether express or implied, including warranties relating to merchantability, fitness for a particular purpose, availability, accuracy, reliability, uninterrupted operation, or non-infringement.

To the fullest extent permitted by applicable law, Psy.nz, its owners, employees, contractors, affiliates, licensors, and partners shall not be liable for any indirect, incidental, consequential, exemplary, punitive, or special damages arising from or related to your use of the Platform. This includes, but is not limited to, loss of income, loss of business opportunities, loss of data, interruption of operations, emotional distress, dissatisfaction with professional services, treatment outcomes, or disputes between users and professionals.

Where liability cannot be excluded under applicable law, the total liability of Psy.nz for any claim arising from the use of the Platform shall not exceed the total amount paid directly to Psy.nz by the affected user during the twelve months preceding the event giving rise to the claim, or US$10 if no payment has been made, whichever amount is greater.

You agree to indemnify and hold harmless Psy.nz, its owners, employees, contractors, affiliates, licensors, and partners from any claims, liabilities, damages, losses, costs, and legal expenses resulting from your use of the Platform, your submitted content, your violation of these Terms, or your infringement of any applicable law or third-party rights.

We reserve the right to suspend, restrict, or permanently terminate any account at our sole discretion where we reasonably believe that these Terms have been violated, fraudulent activity has occurred, or continued access may negatively affect the Platform or its users.

These Terms may be updated periodically to reflect changes in our services, legal requirements, or business practices. Any revised version becomes effective immediately upon publication on the Platform. Continued use of Psy.nz after revised Terms have been published constitutes acceptance of the updated Terms.

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the Platform operator is legally established, unless mandatory consumer protection laws require otherwise. Any disputes arising from these Terms or your use of the Platform shall be resolved by the competent courts of that jurisdiction, except where applicable law provides otherwise.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect without affecting the validity of the remainder of the agreement.
